These Terms and Conditions govern the sale of physical paper books worldwide. By purchasing from this online store, the Buyer agrees to these provisions, tailored specifically to international trade and consumer rights.
1. GENERAL PROVISIONS
1.1. These Terms and Conditions (hereinafter referred to as "Terms and Conditions") of the sole trader Lenka Kořánová, with registered office at Hrádková 2169, 190 16 Prague 21, Czech Republic, Identification Number: 23675357, registered in the Trade Register maintained by the Prague 9 District Authority under Ref. No. ŽOP/ U934/2008/Spu (hereinafter referred to as the "Seller"), govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code of the Czech Republic, as amended (hereinafter referred to as the "Civil Code"), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase agreement (hereinafter referred to as the "Purchase Agreement") concluded between the Seller and any other natural person (hereinafter referred to as the "Buyer") through the Seller's online store. The online store is operated by the Seller on the website located at the internet address wwpbooks.com (hereinafter referred to as the "Website"), via the interface of the Website (hereinafter referred to as the "Web Interface of the Store").
1.2. These Terms and Conditions apply exclusively to consumers (B2C). They do not apply to cases where a person intending to purchase goods from the Seller is a legal entity or a person acting within the scope of their entrepreneurial activity or independent professional practice when ordering goods (B2B).
1.3. Provisions diverging from these Terms and Conditions may be agreed upon in the Purchase Agreement. Such diverging arrangements in the Purchase Agreement take precedence over the provisions of these Terms and Conditions.
1.4. The provisions of the Terms and Conditions are an integral part of the Purchase Agreement. The Purchase Agreement and the Terms and Conditions are executed in the English language. Even though the transaction may take place internationally, the primary legally binding text of these terms is this English version.
1.5. The Seller may amend or supplement the text of the Terms and Conditions. This provision does not affect the rights and obligations components arising during the period of validity of the previous version of the Terms and Conditions.
2. USER ACCOUNT
2.1. Based on the registration of the Buyer on the Website, the Buyer can access their user interface. From their user interface, the Buyer can perform the ordering of goods (hereinafter referred to as the "User Account"). If the Web Interface of the Store allows it, the Buyer can also order goods without registration directly from the Web Interface of the Store as a guest.
2.2. When registering on the Website and when ordering goods, the Buyer is obliged to provide correct and truthful information. The Buyer is obliged to update the data specified in the User Account upon any change. The data provided by the Buyer in the User Account and during the ordering of goods are deemed correct by the Seller.
2.3. Access to the User Account is secured by a username and password. The Buyer is obliged to maintain confidentiality regarding the information necessary to access their User Account.
2.4. The Buyer is not authorized to allow third parties to use their User Account.
2.5. The Seller may cancel the User Account, in particular, if the Buyer has not used their User Account for more than 5 years, or if the Buyer breaches their obligations under the Purchase Agreement (including the Terms and Conditions).
2.6. The Buyer acknowledges that the User Account may not be available continuously, especially with regard to the necessary maintenance of hardware and software equipment of the Seller or third parties.
3. CONCLUSION OF THE PURCHASE AGREEMENT
3.1. The Web Interface of the Store contains information about the goods (physical books), including the prices of individual goods. Product prices are stated inclusive of Czech Value Added Tax (VAT) and all related statutory fees. Product prices remain valid for as long as they are displayed in the Web Interface of the Store. Prices are not customized based on automated decision-making, except for the inclusion of a specific Buyer into the store's loyalty program. This provision does not limit the Seller's ability to conclude a Purchase Agreement under individually negotiated terms.
3.2. The Web Interface of the Store contains information on costs associated with packaging and delivering the goods, along with estimated delivery times. **Important Notice for International Shipments:** Shipping rates displayed on the storefront are subject to geographical zones. Free shipping offers are valid only if the Buyer achieves the minimum order value explicitly defined for their target region in the Web Interface. If the Buyer partially withdraws from the Purchase Agreement, and the remaining order total falls below the minimum limit required for free shipping, the right to free shipping expires, and the Buyer is obligated to pay the standard shipping costs for the retained items.
3.3. To order goods, the Buyer shall fill out the order form in the Web Interface of the Store. The order form contains information regarding:
• The ordered goods (the Buyer adds the items to the electronic shopping cart);
• The method of payment, selected international shipping method, and delivery address details;
• Information on total costs associated with delivery (collectively referred to as the "Order").
3.4. Prior to submitting the Order to the Seller, the Buyer is allowed to check and modify the data entered. The Buyer sends the Order by clicking the "Order and Pay" button, or by initiating a direct checkout via "PayPal" or integrated credit card gates. The data specified in the Order is deemed correct. Upon receipt, the Seller will immediately confirm the Order via email to the Buyer's electronic address (hereinafter "Buyer's Electronic Address").
3.5. The contractual relationship between the Seller and the Buyer is established upon the delivery of the Order acceptance email, except in cases of stock exhaustion or sudden inability of the Seller to fulfill the performance.
3.6. The Buyer agrees to the use of remote communication means when concluding the Purchase Agreement. Costs incurred by the Buyer (internet, telephone calls) are borne entirely by the Buyer according to their local standard rates.
IMPORTANT NOTICE REGARDING INTERNATIONAL CUSTOMS & IMPORT TAXES:
For deliveries to countries outside the European Union (EU), the Buyer acts as the importer of record. The listed
prices do NOT include local import duties, customs fees, clearance fees, or local taxes (such as import VAT or sales
taxes) levied by the destination country. All such additional charges, duties, and handling fees must be borne
entirely by the Buyer. The Seller has no control over these charges and cannot predict their amount. Customs
clearance processes may also cause delays beyond the original delivery estimates.
4. PRICE OF GOODS AND PAYMENT CONDITIONS
4.1. The price of the goods and any costs associated with delivery can be paid by the Buyer via the following secure international methods:
• Comgate Payment Gateway: supporting international credit/debit cards (Visa, MasterCard, Maestro);
• PayPal system: for worldwide electronic payments;
• International Bank Transfer: directly to the Seller's bank account (SWIFT/IBAN).
Please note: Cash on Delivery (COD / dobírka) is not available for international orders. All orders must be fully paid before dispatch.
4.2. Along with the purchase price, the Buyer is obliged to pay the delivery and packaging costs. Unless explicitly stated otherwise, the "purchase price" hereinafter includes the shipping costs.
4.3. The Seller does not require an advance deposit. This does not affect Section 4.6 regarding the requirement of full payment prior to dispatch.
4.4. In the case of electronic or bank transfer payments, the purchase price is due within 14 days from the conclusion of the Purchase Agreement. The shipment process will only begin once the full amount is credited.
4.5. For bank transfers, the Buyer must include the designated variable symbol/order number as a payment reference. The payment obligation is fulfilled when the amount is credited to the Seller's account.
4.6. The Seller reserves the right to demand full payment before shipping the goods. Section 2119(1) of the Czech Civil Code does not apply.
4.7. Discounts or promotional codes provided by the Seller cannot be combined unless stated otherwise.
4.8. The Seller is a registered VAT payer. The tax invoice (Invoice) will be issued following payment clearance and will be delivered exclusively in electronic form to the Buyer's Electronic Address.
5. WITHDRAWAL FROM THE PURCHASE AGREEMENT (RETURN OF GOODS)
5.1. According to consumer protection regulations (Section 1837 of the Czech Civil Code), the Buyer **cannot** withdraw from a purchase agreement for the delivery of newspapers, periodicals, or regular magazines.
5.2. For standard books, the international consumer has the right to withdraw from the contract without giving any reason within fourteen (14) days. The withdrawal period expires 14 days from the day on which the Buyer, or a third party designated by the Buyer (other than the carrier), takes physical possession of the books.
5.3. To exercise the right of withdrawal, the Buyer must notify the Seller via an unequivocal statement sent to the emails: info@wwpbooks.com or lenka@wwpbooks.com. A standard cancellation form can be provided upon request.
5.4. Upon withdrawal, the contract is canceled from the beginning. The Buyer must send back the goods without undue delay, no later than fourteen (14) days from contract cancellation. The Buyer shall bear the direct costs of returning the goods internationally to the Czech Republic, including any cross-border postage, shipping fees, or international handling charges.
5.5. The Seller will refund all payments received from the Buyer, excluding the original standard shipping costs (or a portion thereof if only some items are returned), within 14 days of receiving the withdrawal notice. The refund will be processed via the same payment method used for the initial transaction. Crucial condition: The Seller is not obliged to refund the money before receiving the returned goods back or before the Buyer provides definitive proof of international dispatch, whichever occurs earlier.
5.6. Condition of Returned Books: The Buyer is liable for any diminished value of the books resulting from handling other than what is necessary to establish their nature and characteristics. Books must be returned in perfect condition, packed securely to prevent transit damage. Books must not show signs of use, such as bent corners, creased spines, grease stains, smudges, or torn pages. If a book is returned damaged due to inadequate packaging, the Seller is entitled to unilaterally offset the compensation claim against the Buyer's refund.
5.7. The Seller is entitled to withdraw from the contract at any time prior to shipment due to stock unavailability or logistical restrictions. In such a event, the full purchase price will be immediately refunded to the Buyer's account.
5.8. If a free gift was provided with the goods, the gift agreement includes a resolutive condition: if the Buyer withdraws from the purchase contract, the gift contract becomes void, and the Buyer must return the gift along with the purchased books.
6. SHIPPING, TRANSPORTATION, AND INTERNATIONAL DELIVERY
6.1. If a specific or non-standard delivery method is requested by the Buyer, the Buyer bears the risk and any additional costs associated with such a delivery method.
6.2. The Buyer is obliged to accept the goods upon delivery at the destination address specified in the Order.
6.3. If, due to reasons on the part of the Buyer, the package must be delivered repeatedly or via an alternative method, the Buyer is responsible for all costs associated with such repeated or altered delivery.
6.4. Inspection of Shipment: Upon taking delivery from the international courier (e.g., Packeta, Fedex, UPS, DPD, DHL, local postal services), the Buyer must inspect the outer packaging immediately. If the packaging is severely compromised, crushed, or opened, the Buyer should record photographic documentation and refuse to accept the package from the courier. This allows for a successful insurance claim against the transport company.
6.5. Dispatch Times: Orders are dispatched within 3 to 5 business days after full payment is received. If a book is temporarily delayed or unavailable, the Buyer will be notified immediately via email.
6.6. Global Delivery Times: Shipping duration varies significantly depending on the destination country, customs clearance speeds, and the selected shipping partner. The Seller is not responsible for transit delays caused by foreign customs procedures or regional postal strikes.
7. RIGHTS FROM DEFECTIVE PERFORMANCE (WARRANTY & CLAIMS)
7.1. Quality Commitment: The Seller guarantees that the books will arrive in sound condition and free of manufacturing defects. A defect is defined as a damaged binding, missing pages, severe printing errors, or systemic physical damage that prevents normal reading.
7.2. Warranty Period: For consumers, the legal warranty period is 24 months from the date of delivery.
7.3. Claim Remedies: If a book has an eligible defect, the Buyer has the right to:
1. A replacement copy of the book (new piece);
2. An appropriate discount on the price;
3. Full refund (withdrawal from contract) if a replacement copy cannot be supplied due to being permanently out of stock.
7.4. Claim Procedure: To initiate a claim, please contact info@wwpbooks.com or lenka@wwpbooks.com with your order number and **photographic evidence of the defect**. For international clients, this photographic proof is mandatory to avoid the need for shipping the heavy defective item back across borders unnecessarily.
7.5. Damaged/Discounted Stock Section (Doprodej poškozených výtisků): The general 24-month warranty does not apply to items clearly marked as "damaged stock", "outlet", or "used". These items carry minor aesthetic defects caused by long-term storage, exhibition, or handling. The inner contents remain fully readable.
• 7.5.1. The warranty period for such used/damaged books is shortened to 12 months.
• 7.5.2. The Buyer cannot claim defects or wear corresponding to the declared degree of damage or previous use for which the book was discounted.
• 7.5.3. For justified claims on used items, the Buyer is entitled to a discount or refund if no comparable discounted copy is available in stock.
7.6. Rights from defective performance do not apply if the defect was caused by the Buyer (e.g., liquid damage, rough handling, improper storage conditions).
7.7. Resolution Timeframe: The Seller will evaluate the international claim within 7 business days and inform the Buyer of the solution. The claim will be fully resolved without undue delay, at most within 30 days of submission.
7.8. If a claim is justified, the Buyer is entitled to reimbursement of reasonably incurred expenses. For international shipping, such costs must be pre-approved by the Seller.
8. MISCELLANEOUS RIGHTS AND OBLIGATIONS
8.1. Retention of Title: The Buyer acquires ownership of the goods only after full payment of the entire purchase price.
8.2. Codes of Conduct: The Seller is not bound by any specific codes of conduct within the meaning of Section 1820(1)(n) of the Czech Civil Code.
8.3. Complaints handling: Consumer complaints are handled by the Seller via email at info@wwpbooks.com. Notification of resolution will be sent to the Buyer's email.
8.4. Dispute Resolution (EU Customers): To resolve out-of-court consumer disputes, European Union residents may utilize the official EU Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr or contact the Czech Trade Inspection (Česká obchodní inspekce -ČOI), Central Inspectorate, ADR Department, Gorazdova 24, 120 00 Prague 2, Czech Republic (internet address: coi.gov.cz).
8.5. The Buyer assumes the risk of changing circumstances under Section 1765(2) of the Czech Civil Code.
9. DATA PROTECTION (GDPR)
9.1. The Seller complies with the European General Data Protection Regulation (Regulation EU 2016/679 GDPR). The personal data of the Buyer is processed strictly for the execution of the Purchase Agreement and fulfillment of accounting and tax laws. Complete details regarding personal data handling are available in a dedicated Privacy Policy document on the website.
10. COMMERCIAL COMMUNICATIONS AND COOKIES
10.1. The Buyer may opt-in to receive promotional newsletters. This consent can be withdrawn at any time. The store processes data according to current digital privacy legislation.
10.2. Third-Party Data Handlers: To guarantee seamless international delivery, the Buyer's contact data (Name, Address, Email, Phone) will be securely transmitted to reliable logistic operators, including: **Česká pošta**, shipping aggregators **Zaslat** and **Zásilkovna (Packeta)**, and globally recognized couriers such as **FedEx, UPS, DPD, or DHL**. No personal data is sold or provided to unrelated third-party commercial marketing firms.
11. FINAL PROVISIONS
11.1. Governing Law and Jurisdiction: The Purchase Agreement and all relationships arising from it shall be governed by and construed in accordance with the laws of the **Czech Republic**, excluding its conflict of laws principles. However, if the Buyer is a consumer, this choice of law does not deprive them of the protection afforded by provisions that cannot be derogated from by agreement under the law of their habitual residence (Article 6(1) of Regulation Rome I).
11.2. If any provision of these Terms is found to be invalid or unenforceable, it will not affect the validity of the remaining provisions. The invalid clause will be replaced by a valid provision closest in spirit to the original intent.
